ORDER denying #10 Plaintiff's Motion to File Amended Complaint; denying #10 Motion for Protective Order. Plaintiff has failed to attach a copy of his proposed amendment to his motion. The Court of Appeals for the Third Circuit has held that a request for leave to amend must be accompanied by a draft amended complaint so that the Court can determine whether any amendment would be futile. See Fletcher-Harlee Corp. v. Pote Concrete Contractors, Inc., 482 F.3d 247 (3d Cir. 2007) ("[F]ailure to submit a draft amended complaint is fatal to a request for leave to amend."). Plaintiff's motion will be denied, without prejudice, based on his failure to attach a draft of his proposed Amended Complaint. His motion for a protective order is likewise denied. To the extent the Plaintiff understands the protective order the Court previously entered in Case No. 22-cv-078 as one which protects him from any type of abuse, the Court clarifies that the prior protective order concerns the confidentiality of materials that may be disclosed during the discovery process.
