January 18, 2024 Opinion or Order Filing 12 TEXT ORDER granting #6 Motion to Extend Time and dismissing #3 Motion to Dismiss: NOW, this 18th day of January, 2024, upon consideration of Plaintiff's motion to extend the time to respond to the Defendant's motion to dismiss the complaint, ECF No. #6 , as well as Defendant's response thereto, ECF No. #8 , IT IS ORDERED that the Plaintiff's motion for an extension of time #6 is GRANTED. The parties have indicated their mutual agreement to the Court first ruling on the Plaintiff's motion to remand this civil action back to state court (ECF No. #5 ) and then, if necessary, addressing Defendant's motion to dismiss the complaint. To that end, IT IS ORDERED that the Defendant's motion to dismiss at ECF No. #3 shall be, and hereby is, DISMISSED without prejudice. In the event that Plaintiff's motion to remand is denied, Defendant shall have the right, within ten (10) days after the Court's denial of a remand, to reassert its motion to dismiss.
