The Governments motion is grante d to the extent that it seeks dismissal of Plaintiffs claim for breach of an express contract pursuant to Federal Rule of Civil Procedure 12(b)(1), as this Court lacks jurisdiction over said claim. It is denied to the extent that it seeks dismissal of Plaintiffs claim for breach of an implied contract pursuant to Rules 12(b)(1) and 12(b)(6). An appropriate order follows.
