MEMORANDUM OPINION granting in part and denying in part 28 Defendant's Motion for Summary Judgment. For reasons set forth within, the court will grant defendant's motion for summary judgment with respect to plaintiff's unseaworthine ss (count I) and Jones Act negligence claims (count II). The defendant's motion for summary judgment with respect to plaintiff's claim under the LHWCA (count III) and negligence under general maritime law (count IV) will be denied.
