Plaintiff's Mo tion for Summary Judgment (Docket No. 44) is granted as follows: a. summary judgment is warranted in Plaintiff's favor as to his substantive due process claims as it relates to FCCYS' Protocol, Ms. Schuessler, and Ms. Coll; b. summary judgm ent is warranted in Plaintiff's favor as to his procedural due process claims; c. summary judgment in favor of Plaintiff that he did not waive his substantive and procedural due process rights is warranted; and d. summary judgment in favor of Pl aintiff is warranted as to Plaintiff's First Amendment claim. 2. Plaintiff's Motion for Summary Judgment (Docket No. 44) is denied in all other respect.
