Filing 67 MEMORANDUM OPINION granting, in part, 39 Defendant's Motion for Summary Judgment. As set forth more fully within the court determined that plaintiffs did not establish any genuine issues of material fact with respect to the federal claim asser ted against defendant and defendant is entitled to judgment as a matter of law on that claim. Summary judgment is granted in favor of defendant with respect to count VI. The court declines to exercise supplemental jurisdiction over plaintiffs' Pennsylvania law causes of action in counts VII and VIII of the Amended Complaint pursuant to 28 U.S.C. § 1367(c)(3).
