ORDER denying 27 Motion for Partial Summary Judgment. AND NOW, this 28th day of September, 2010, after careful consideration of the submissions of the parties and for the reasons set forth in the Opinion accompanying this Order, it is ordered that Defendants Motion for Partial Summary Judgment to Dismiss Count II of Plaintiffs Amended Complaint (Docket No. 27) is denied. It is further ordered that the stay of discovery is lifted and that the parties shall complete discovery in this matter by November 1, 2010. A Pretrial/Settlement conference is scheduled for November 2, 2010 at 1:00 p.m. before the undersigned in Courtroom 3B of the U.S. Post Office & Courthouse, 700 Grant Street, Pittsburgh, Pennsylvania. Counsel shall have settlement authority, and parties are to be either present or available by telephone. OPINION AND ORDER OF COURT: denying 8 Motion to Dismiss; granting 8 Motion to Strike. AND now, this 6th day of November, 2009, upon consideration of the Partial Motion to Dismiss 8 Pursuant to Federal Rule of Civil Procedure 12(b)(6) and Motio n to Strike Pursuant to Federal Rule of Civil Procedure 12( f), filed by Defendants, it is hereby ORDERED that Defendants' Partial Motion to Dismiss is DENIED, Defendants Motion to Strike is GRANTED to the extent that references to settlement ne gotiations contained in Paragraph 11 of Plaintiffs Amended Complaint are stricken and Exhibit "C" relating to settlement negotiations is also stricken.
