IT IS FURTHER ORDERED that the Re port and Recommendation, ECF No. 4 , filed on March 11, 2013, by Magistrate Judge Kelly, is adopted as the opinion of the court, except to the extent that the Report relied upon Plaintiffs failure to allege properly the citizenship of all the partie s because Plaintiff showed he could cure this defect in his objections. The Clerk is to mark the case closed. Any further amendment of the Complaint would be futile.
