MEMORANDUM ORDER granting in part and denying in part 88 Motion for Summary Judgment and adopting 116 Report and Recommendation filed on March 3, 2016 as the Opinion of the Court as supplemented by this Memorandum Order. In particular, Defendan ts' Motion for Summary Judgment is denied as to Plaintiff's Eighth Amendment failure to protect claim against Defendant Harkleroad, and is granted as to all of Plaintiff's other claims against all of the named Defendants. It is furthe r ordered that the following claims are dismissed with prejudice: Plaintiff's purported First Amendment retaliation claims; Plaintiff's Eighth Amendment claims against Defendants Lieutenant Shrader and Lieutenant Grego; Plaintiff's Fou rteenth Amendment Due Process claims; and Plaintiff's common law conversion claim brought under Pennsylvania law.
