Judgment will be entered in favor of the Bentz Defendants with respect to Counts I, II, and III. Judgment will be denied as to Counts V, VI and VII. Instead, Counts V, VI and VII will be dismissed without prejudice to Plaintiff refiling those claims in state court. C.A. Bentz LLC's Motion for Summary Ju dgment 267 will be granted.
