Defendants motion for summary judgment (Doc. No. 41) is GRANTED IN PART and DENIED IN PART as follows:a. The motion is GRANTED as to Count II of the second amended complaint (Doc. No. 19), and the Clerk of Court is directed to defer the entry of judgment as to Count II in favor of Defendant EQ T Corporation Severance Pay Plan and against Plaintiff until the conclusion of the above-captioned proceedings;b. The motion is DENIED as to Counts I, III, IV, and V of the second amended complaint (Doc. No. 19);2. Consistent with the Memorandum issu ed concurrently with this Order, the parties are directed to submit, within ten (10) days of the date of this Order, a joint report as to the status of the above-captioned action that specifically informs the Court as to whether Plaintiff intends to pursue a jury trial as to his claims asserted at Counts III, IV, and V of the second amended complaint; and3.
