MEMORANDUM OPINION indicating that, for reasons more fully stated within, the Court grants Defendant Eddy Homes, Inc.'s Motion to Dismiss Plaintiff's First Amended Complaint Pursuant to Federal Rule of Civil Procedure 12(b)(6) 9 . Plaintiff's claim for copyright infringement is dismissed, with prejudice, and Plaintiff's claim for unfair competition is dismissed, without prejudice. An appropriate Order follows.
