Filing 24 MEMORANDUM & ORDER. For the reasons stated in the Memorandum & Order filed herewith, Defendant Turnpike's Motion to Dismiss (Doc. 17 ) is GRANTED and Defendant Longo's Motion to Dismiss (Doc. 19 ) is DENIED. Consistent with the foregoing , the Court hereby DISMISSES WITHOUT PREJUDICE Counts I and II of the Complaint against Defendant Turnpike. If Plaintiff wishes to file a Second Amended Complaint, she must do so on or before March 15, 2017. Defendants must answer or otherwise plead fourteen (14) days thereafter. Should no Second Amended Complaint be filed by March 15th, the Court will assume that Plaintiff intends to pursue her claims solely against Defendant Longo. Signed by Judge Cathy Bissoon on 3/1/2017.
