Filing 26 MEMORANDUM AND ORDER. For the reasons stated in the Memorandum and Order filed herewith, Defendants' Motion to Dismiss the Amended Complaint (Doc. 21) is GRANTED IN PART and DENIED IN PART. Consistent with the foregoing, the Court hereby DISMI SSES with prejudice Count I of the Amended Complaint against the Defendant School District, as well as Count II of the Amended Complaint against the individual Defendants Hoover and Castagna. The Court hereby DISMISSES WITHOUT PREJUDICE Count I of the Complaint against all Defendants and Count II of the Complaint against the individual Defendants Hoover and Castagna. Further, the Court hereby DISMISSES WITH PREJUDICE Plaintiff's official capacity claims against Defendants Hoover and Castagna at Count II of the Co mplaint and the conspiracy claim against Defendants Hoover and Castagna at Count III of the Complaint.
