MEMORANDUM AND ORDER. For the reasons stated in the Memorandum & Order filed herewith, Defendant City of Pittsburgh's Motion to Dismiss (Doc. 38 ) is GRANTED, and Plaintiff's claims against the City are DISMISSED without prejudice. Plaintiff shall file a Second Amended Complaint on or before 10/17/17. Failure to do so will result in his claims against the City being dismissed with prejudice.
