April 21, 2021 Opinion or Order Filing 298 Plaintiffs' Motion for Sanctions (Doc. #289 ) is DENIED. Throughout this case, counsel for both parties have engaged in a pattern of "gotcha" litigation tactics that strains the bounds of professionalism. The latest motion from Plaintiffs demonstrates more of the same. Rather than make efforts to work cooperatively, Plaintiffs instead have decided to attempt to invoke this Court's sanctioning authority to punish Defendants for the most egregious of sins -- rolling out their privilege log over the course of a couple of weeks. Simply put, what Plaintiffs seek here is preposterous under the circumstances presented. Leaving aside the fact that Plaintiffs have seen fit to wholly ignore the Court's Practices and Procedures governing discovery in favor of "guerilla warfare," Defendants have complied with their discovery obligations, albeit late. While the Court questions whether Defendants truly lived up to the "substantial completion" language in the Court's Order, the Court's Order did envision a rolling production of this information. Moreover, Defendants explained the roll-out. This Court is not in the business of sanctioning parties who have complied with their discovery obligations. That Defendants engaged in a two-week rolling production does not change that analysis. All counsel in the matter need to take a step back, maybe count to 10, and evaluate whether these antics are truly worth the expenditure of client funds. The best litigators pick their battles -- they do not die on every hill. Counsel is hereby ORDERED to share the instant Order with their clients immediately, and certify under penalty of perjury by Monday, April 26, 2021, that they have done so. Given this, the Court orders the parties to meet and confer regarding all outstanding discovery requests. To that end, each party must exchange with opposing counsel a detailed proposed order regarding any and all remaining discovery disputes on or before December 1, 2020. On or before December 3, 2020, the parties must meet via video to discuss the competing proposed orders in an effort to reach consensus. THIS SESSION MUST BE RECORDED, and said recording shall be jointly submitted to the Court should the parties not reach consensus. Should the parties fail to reach agreement on any outstanding discovery issue, in addition to the above-referenced recording, the parties shall submit to the Court, by December 7, 2020, their competing proposed orders regarding their outstanding discovery issues. The Court will review each order and will sign the most reasonable order, WITHOUT ALTERATION, that is consistent with the Federal Rules of Civil Procedure. In light of these ongoing discovery disputes, and to provide the parties with unfettered time to discuss these issues, this case is STAYED until December 7, 2020, pending resolution of the parties' discovery issues. For the duration of the stay, this case will remain administratively closed. On August 16, 2017, the Court ordered that any subsequently filed related actions to Civil Action No. 17-579 would be consolidated at Civil Action No. 17-579 due to the benefits of consolidating putative securities class actions involving substantially similar legal and factual issues and common defendants. (Civil Action No. 17-579, Doc. 47.) On April 24, 2019, three putative securities class actions were filed in this Court against U.S. Steel Corporation, Mario Longhi, David B. Burritt, and Dan Lesnak, who are also defendants in Civil Action No. 17-579. (Civil Action Nos. 19-468, 19-469, and 19-470, collectively the "newly filed securities class actions.") The newly filed securities class actions involve substantially the same facts and legal issues as in Civil Action No. 17-579, and counsel for Plaintiffs in the newly filed securities class actions is also counsel for Plaintiffs in Civil Action No. 17-579. Accordingly, on April 25, 2019, the Court ordered Plaintiffs in the newly filed securities class actions to show good cause as to why those cases should not be consolidated with Civil Action No. 17-579.
