OPINION & ORDER granting 5 MOTION TO DISMISS FOR FAILURE TO STATE A CLAIM filed by STATE FARM MUTUAL AUTOMOBILE INSURANCE COMPANY as set forth in the opinion. Count III of Plaintiff's Complaint is dismissed, without prejudice, for failure to state a claim upon which relief can be granted. Plaintiff may file an amended complaint to reassert this claim.If Plaintiff chooses to file a curative amended complaint to reassert her dismissed claim, such amended complaint must be in accord with the Opinion accompanying this Order and be filed no later than fourteen (14) days from the date of this Order.
