Filing 55 ORDER granting 34 Motion to Dismiss filed by Defendant City of Pittsburgh and it is dismissed from this action with prejudice ; adopting Report and Recommendations re 54 Report and Recommendations is adopted as the Opinion of the Court. I T IS FURTHER ORDERED that pursuant to 28 U.S.C. §§ 1915(e)(2)(B)(ii)-(iii), Defendant Gilmore is sua sponte dismissed from this action with prejudice. IT IS FURTHER ORDERED that the remaining claim in this case is dismissed without prejudi ce because it is duplicative to claim nine at Civil Action No. 17-988. IT IS FURTHER ORDERED that the Clerk of Court mark this case CLOSED. AND IT IS FURTHER ORDERED that pursuant to Rule 4(a)(1) of the Federal Rules of Appellate Procedure, Plaintiff has thirty (30) days to file a notice of appeal as provided by Rule 3 of the Federal Rules of Appellate Procedure.
