Plaintiff's motion is insufficient because it fails to identify any specific basis in Rule 60(b) for the motion, nor does it develop an argument under one of those standards. In addition, the motion's reference to plaintiff counsel's belief that valid settlement discussions were taking place is, without more, insufficient to meet the minimal standards under any of the grounds articulated in Rule 60(b). To the extent that plaintiff's motion seeks special permission to amend the complaint, the court's order of dismissal does not prejudice plaintiff's ability to amend its complaint on remand to state court, to the extent permitted by that court.
