Filing 8 Authorization permitting withdrawal of prison account funds to pay filing fee by HASAN SHAREEF. (cjo) |
Filing 6 ORDER re #4 Plaintiff's Authorization. Plaintiff returned his Authorization form to the Court. However, upon review, it appears that Plaintiff signed his name under both sections indicating that he authorized payments for the filing fee and indicating that he wished to withdraw this action. Plaintiff was to sign his name under only one section. The Clerk shall send Plaintiff another Authorization form. Plaintiff is instructed to sign his name under the appropriate section. For example, if he desires to proceed with this case then he should sign his name under the section authorizing payments for the filing fee. If he does not desire to proceed with this case then he should sign his name under the Withdrawal of Action section. Plaintiff shall NOT sign both sections. Signed by Magistrate Judge Lisa Pupo Lenihan on November 4, 2019. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (kcc) |

Filing 2 ORDER granting #1 Plaintiff's Motion for Leave to Proceed in forma pauperis to the extent that the case may proceed without the prepayment of the entire filing fee. Plaintiff shall pay $79.10 as an initial partial filing fee as provided by 28 U.S.C. 1915(b)(1)(A); however, he is still assessed the total $350.00 filing fee. The agency having custody of Plaintiff shall forward, within THIRTY (30) DAYS from the date of this Order, the initial partial filing fee of $79.10 to the Clerk of Court. After payment of the initial partial filing fee, Plaintiff shall be required to make monthly payments of twenty percent of the preceding month's income (that is, all funds deposited into the account) credited to the account. Plaintiff is warned that he is ultimately responsible for payment of the filing fee if the agency with custody over him lapses in its duty to make payments on his behalf. The Clerk of Court shall mail a copy of this Order to the Inmate Account Officer at Plaintiff's place of confinement. The Clerk of Court shall enclose an authorization form which Plaintiff shall complete and return within ten (10) days of this Order. If Plaintiff authorizes payments and the initial partial filing fee of $79.10 is not received within THIRTY (30) DAYS from the date of this Order then this action may be dismissed for Plaintiff's failure to prosecute. The Clerk of Court is directed to file the Complaint and any attachments thereto. Signed by Magistrate Judge Lisa Pupo Lenihan on October 18, 2019. (Attachments: #1 Exhibit Authorization). (kcc) |
