Filing 82 ORDER denying #71 Plaintiff's Motion to Compel. Having reviewed the July 27, 2022 letters from Defendants to Plaintiff regarding the reasons for redactions and Defendants' response to the motion to compel, the Court finds that the redactions based upon the described security reasons are appropriate. Moreover, documents that relate to other inmates are irrelevant based on the claims asserted by Plaintiff, and Plaintiff's medical records for years other than the relevant time period, which Defendants represent are voluminous, are similarly irrelevant. As reflected in Defendants' July 27, 2022 letter regarding the documents that were produced, they have produced over 700 pages of documents that include, but are not limited to, Plaintiffs medical records from April 2018 through June 21, 2021, investigative materials, videos, grievances, misconducts, PREA reports, photos, a log book, duty roster, and other reports. For these reasons, the Court does not find it necessary to conduct an in camera review of the redactions. Signed by Magistrate Judge Patricia L. Dodge on 3/6/2023. Filing 74 ORDER denying #72 Motion for Extension of Time. In an order dated December 28, 2022, Plaintiff was informed that: "The deadline for the deposition of Plaintiff is extended until February 3, 2023. No other fact discovery is permitted. If Plaintiff intends to file any of the motions identified in his Motion for a Stay of Discovery Proceedings other than a motion to seek additional discovery, which is not permitted, he shall file any such motions no later than January 19, 2023." The motion for extension of time was not placed in the mail until January 26, 2023 and the motion itself does not identify what motions Plaintiff intends to file. In his motion for a stay, which was ultimately denied, Plaintiff indicated that he intended to file a motion for appointment of counsel, a motion for appointment of a mental health expert, a motion to compel and a motion to reopen discovery. Motions for appointment of counsel or mental health experts are not discovery-related motions and Plaintiff is not precluded from filing these motions at any time. As noted, he has already been notified that the other proposed motions are not permitted.Signed by Magistrate Judge Patricia L. Dodge on 2/2/2023. Text-only entry; no PDF document will issue. Filing 69 ORDER denying #66 Plaintiff's Motion for a Stay of Discovery Proceedings. If Plaintiff asserts that Defendants have not produced requested discovery, he must file a motion to compel in which he specifically identifies the discovery responses that he believes are deficient and states why the discovery sought is relevant to his claims. Plaintiff previously represented in a status notice [ECF 56] that he received over 600 pages of documents on October 4, 2022 and stated that he needed additional time to review them and determine if any further discovery was required. In the 11/14/22 order [ECF 58] granting him additional time to do so, he was required to serve any additional discovery by December 5, 2022 and was advised that no additional discovery would be permitted. He had sufficient time to conduct his review and serve additional discovery, and the motion for a stay fails to adequately support a request for additional time to conduct discovery. Plaintiff also fails to support his assertion that he should not be deposed in this case. Plaintiff has actively engaged in the prosecution of this case since August 2020, including multiple amendments of his complaint and the assertion of multiple motions, despite what he asserts are his current diagnoses. He provides no compelling reason why he cannot be deposed regarding his claims. However, because Plaintiff asserts that he intends to file various motions and defendants do not object to a reasonable extension of time for him to do so, an amended case management order will be issued. Rule 5.2 relates to privacy protection for filings made with the Court that contain information such as social security numbers, financial account numbers, birth dates and the like. Rule 5.2(e) relates to protective orders requesting redaction of such information or limiting remote access to a document filed with the Court, and thus, is not applicable here. Defendants complied with the DOC policy regarding how and where to mail pleadings and other documents to Plaintiff. These documents are not privileged and Defendants are required to follow the DOC policy. The Court will routinely provide additional time to Plaintiff in recognition of slight delays associated with Plaintiff's receipt of mail from Defendants, and Plaintiff may also request additional time if necessary. The Court has no basis to intervene in internal DOC mailing policies or to "disqualify" Smart Communications from its role in processing inmate mail. As an accommodation to Plaintiff, however, the Court will provide Plaintiff with a courtesy copy of Defendants' Answer since he indicates that he did not receive it..
