NTEU, 513 U.S. 454 (1995) applies, and if so, discuss the application of that standard to the pending motion. See Swartzwelder v. Upon review of the Port Authority's #10 Partial MOTION to Dismiss for Lack of Jurisdiction, it appears to the Court that the parties are in agreement that the operative policy at-issue is the amended mask policy enacted by the Port Authority on September 16, 2020, which the Union contends in its briefing is also unconstitutional. The Court agrees with the Port Authority that the Union cannot amend its complaint through its briefing, and so will GRANT the motion to dismiss. However, the Court will also grant the Union's alternative request for leave to amend its complaint, and adjust the pre-hearing schedule as follows: The Union shall file an amended complaint, stating a claim against the operative mask policy, by 11/3/2020. The deadline for the parties to submit pre-hearing briefs, exhibits, and witness lists shall be extended until 11/5/2020.
