December 10, 2020 Opinion or Order Filing 5 ORDER re #4 the Petition for Review that was received and docketed on December 8, 2020. Petitioner states that he is "bringing forth a complaint for obstruction of justice" because his "account for filing fee was deliberately held in account office." It is unclear what Petitioner intends with this filing. This case was administratively closed on November 19, 2020 due to Petitioner's failure to pay the $5.00 filing fee or submit a motion for leave to proceed in forma pauperis (IFP), and Petitioner was told that the case would be reopened upon the receipt of the filing fee or if a submitted motion for IFP was granted. See ECF No. 2. It appears that Petitioner is saying that the Inmate Account Office will not send in the filing fee for this case. The Court has never had an issue with the DOC withholding payments for filing fees in cases. If Petitioner believes that the Inmate Account Officer at his place of confinement is doing so then he should provide him/her with a copy of this order. If Petitioner still believes that the filing fee is being withheld then he may submit a motion for IFP with a copy of his prisoner account statement for the previous 6 months. Signed by Magistrate Judge Lisa Pupo Lenihan on December 10, 2020. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (kcb)

Text-only entry. No PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (bdb)
November 19, 2020 Opinion or Order Filing 2 ORDER that the Clerk is to mark this CASE CLOSED. Petitioner may submit a motion to proceed in forma pauperis, along with a certified copy of the inmate account statement for the six (6) months preceding the filing of his Petition. If that motion is granted, the case will be reopened. Petitioner may also reopen this case by paying the $5.00 filing fee. Petitioner is allowed fourteen (14) days from this date to appeal this order to a District Judge pursuant to Rule 72.C.2 of the Local Rules. Failure to appeal within fourteen (14) days may constitute waiver of the right to appeal. Signed by Magistrate Judge Lisa Pupo Lenihan on November 19, 2020. (kcb)
November 12, 2020 Filing 1 Remark: Petition for Writ of Habeas Corpus received with no filing fee or IFP Motion. (Attachments: #1 USCA Order) (lar)
