ORDER construing #9 Plaintiff's Correspondence and Prisoner Trust Fund Account Statement filed by JOSEPH M. HISEL as a renewed Motion for Leave to Proceed in forma pauperis and granting same. Within THIRTY (30) DAYS of the date of this Order, Plaintiff shall pay $180.24 as an initial partial filing fee, as explained more fully herein. Plaintiff shall return the enclosed Authorization Form within TEN (10) DAYS of the date of this Order. The Clerk of Court shall mail a copy of this Order to the Inmate Account Officer at Plaintiff's place of confinement if and once Plaintiff has returned his Authorization Form. If Plaintiff fails to return the Authorization Form within TEN (10) DAYS of the date of this Order, or if Plaintiff authorizes payments and the initial partial filing fee is not received within THIRTY (30) DAYS of the date of this Order, then this action may be dismissed for failure to prosecute. ORDER re #6 Affidavit in Support of Motion filed by JOSEPH M. HISEL. Plaintiff states that he has $534 in his inmate account at the Lawrence County Jail but that the inmate account officer at the jail will not give him a copy of his account statement. IT IS HEREBY ORDERED that the inmate account officer of Lawrence County Jail is instructed to either furnish Plaintiff or to furnish this Court with a copy of Plaintiff's inmate account statement showing Plaintiff's current balance and all transactions since June 2020, and they should do so no later than February 26, 2021. If sending directly to the Court, the inmate account officer should clearly mark the account statement with the instant case number (2:21-cv-117). If furnishing directing to Plaintiff then Plaintiff is instructed to also write his case number on the statement and mail it to this Court as soon as possible. The Clerk of Court is directed to send a copy of this Order to the inmate account officer at the Lawrence County Jail, 111 S. Milton Street, New Castle, PA, 16101. ORDER that Plaintiff's Motion to Proceed In Forma Pauperis (ECF. No. #1 ) is DENIED. IT IS FURTHER ORDERED that the Clerk of Court is directed to mark this case closed. IT IS FURTHER ORDERED that the plaintiff may submit another motion to proceed in forma pauperis, along with a certified copy of the inmate account statement for the six (6) months preceding the filing of the complaint. AND IT IS FURTHER ORDERED that the parties are allowed fourteen (14) days from this date to appeal this order to a district judge pursuant to Local Rule 72.C.2.
