ORDER re: #1 Motion for Leave to Proceed In Forma Pauperis. Upon consideration, the motion to proceed in forma pauperis is GRANTED. The Court has reviewed Ms. Kirby's representations regarding her financial status and, based on those representations, agrees that she is unable to pay fees. Additionally, the Court has reviewed the allegations in Ms. Kirby's complaint and finds that they are not so "frivolous," "malicious," or lacking in subject-matter jurisdiction as to warrant dismissal under 28 U.S.C. 1915(e)(2)(B). That is, while the Court can foresee arguable difficulties for aspects of Ms. Kirby's claim based on, for example, the Rooker-Feldman and Younger abstention doctrines or the statute of limitations, it is not obvious that those doctrines apply to all aspects of her claims (e.g., Rooker-Feldman and Younger generally do not bar damages claims, and Ms. Kirby makes allegations related to Defendants' more recent actions as well). Any more subtle deficiencies are better addressed in the context of a fully briefed motion to dismiss. As a result, Ms. Kirby's [1-1] proposed complaint shall be deemed filed, and she may proceed with serving the complaint and summons on Defendants in accordance with the Federal Rules..
