CASE MANAGEMENT ORDER: Compliance with provisions of Rule 16 shall be completed as follows: Initial disclosures pursuant to Fed. R. Civ. P. 26(a) shall be made by August 11, 2021. Amendments to the pleadings and joinder of additional parties will be completed by November 10, 2021. The ADR process will be completed no later than March 31, 2022. A telephone status conference is scheduled for October 19, 2021 at 10:00 AM. Counsel are to call into the conference by dialing 888-363-4749 and entering the access code 6019141. If asked for a security code, use * to bypass. The parties shall complete fact discovery by February 22, 2022. All interrogatories, depositions and requests for admissions and/or production of documents shall be served within sufficient time to allow responses to be completed prior to the close of discovery. If the parties are unable to resolve a discovery dispute following a meet and confer, they are to contact the Court to schedule a telephone conference prior to filing a discovery related motion. A status/settlement conference will be held on February 24, 2022 at 10:00 AM. Trial counsel shall attend and the parties shall be available by telephone. No later than 5 business days prior to the conference any party intending to file a motion for summary judgment shall file a statement, no longer than 3 pages, setting forth the grounds on which the motion will be filed. | Filing 11 Minute Entry for proceedings held before Magistrate Judge Lisa Pupo Lenihan: A Telephonic Initial Case Management Conference was held on 7/22/2021. Plaintiff sustained burns primarily to her right hand, causing scarring and use issues. The current medical lien is $50,000 and there are additional medical bills outside the lien. Defendant states it did not sell the product in question. Counsel for Defendant has a heavy fall trial schedule and asks for an extended discovery period. In addition, both parties do not think ADR will be useful without discovery as to whether Defendant sold the product and therefore ask that the ADR take place after fact discovery. They are scheduling an ENE but that may turn into a mediation. The Court will allow a later ADR deadline, but the parties are encouraged to engage in ADR earlier if possible.
