REPORT AND RECOMMENDATION re #3 Complaint filed by ROBERT W. JOHNSON recommending that Plaintiff's Complaint, which was commenced in forma pauperis, be dismissed without prejudice pursuant to 28 U.S.C. 1915(e)(2)(B), as frivolous, and for failure to state a claim upon which relief may be granted. It is further recommended that Plaintiff be given the opportunity to amend his claim for discrimination in the award of benefits, specifically to include facts concerning the alleged discrimination, and how all named Defendants were personally involved in the alleged discrimination. It is also recommended that Plaintiff be given 20 days from the date of an order adopting this Report and Recommendation to file an Amended Complaint should he wish to proceed with this civil action.
