ORDER granting #6 Motion to Remand to State Court. In order to remove a case to federal court, the removing party must be a defendant in the underlying case. Mr. Shi is not a defendant in the underlying eviction action; rather, he is an intervenor. As such, he cannot remove the case. See 28 U.S.C. 1446(a) ("A defendant or defendants desiring to remove any civil action..."). The Court directs the Clerk of this Court to remand this case forthwith to the Magisterial District Court.
