ORDER in response to Plaintiff's #11 Correspondence dated 3/4/2024. Plaintiff is advised that Judy Smith is a defendant in his case at 2:23-cv-354, in which he asserts claims related to alleged events that occurred when he was at SCI Pine Grove. Counsel has entered an appearance for Defendant Smith, as well as for Defendants Superintendent Lee Estock, Mr. Sheeder, Richard Coon, Officer Martin, Lt. Box, Officer Pavlosky and Mr. Yingling and their responsive pleading to the Complaint is due on 4/8/2024. Plaintiff is further advised that in the Court's 1/17/2024 order that directed the Clerk of Court to open a new civil action (now 2:24-cv-67) in which Plaintiff may assert claims against the SCI Mercer Defendants, the Court inadvertently omitted Gerald Roth (whom Plaintiff identifies as a security captain at SCI Mercer) in the list of those defendants for that new civil action. Therefore, the Court's 1/17/2024 order is amended to reflect that Gerald Roth is a named defendant in Plaintiff's case at 2:24-cv-67 and he is terminated as a defendant in Plaintiff's case at 2:23-cv-354. Plaintiff is reminded that, because he notified the Court that he wanted to file an amended complaint in his case at 2:24-cv-67, and pursuant to the Court's 2/27/2024 #8 order, his Amended Complaint in 2:24-cv-67 is due on 3/28/2024.
