Filing 2 MEMORANDUM OPINION - the Petition filed by LAWRENCE EGGLESTON was received without the filing fee or a motion for leave to proceed in forma pauperis. The Court may dismiss the petition prior to service if it plainly appears that Eggleston is not en titled to habeas relief. That is the case here because the instant petition is a second or successive petition and Eggleston does not assert that he has received from the United States Court of Appeals for the Third Circuit an order authorizing this Court to consider it, as required by 28 U.S.C. § 2244(b)(3)(A).
