Filing 6 ORDER re 12(b) Motions. Signed by Judge Robert J. Colville on 3/21/24. (cjo) |
Filing 5 NOTICE that instant civil action has been designated for placement into the United States District Court's Alternative Dispute Resolution program. Parties are directed to fully complete the required 26(f) report, which includes the stipulation of selecting an ADR process. Counsel for plaintiff (or in the case of a removal action, counsel for removing defendant) shall make service of the notice on all parties. (cjo) |
Filing 4 ORDER: To the extent Plaintiffs Complaint #1 seeks a temporary restraining order, that request is denied, without prejudice. A court may issue a temporary restraining order, without notice to the adverse party, only when the requirements of Fed. R. Civ. P. 65(b) have been met. Following a review of the Complaint, the Court finds that Plaintiff has not satisfied the criteria for a temporary restraining order at this juncture. If Plaintiff instead intends to seek a preliminary injunction, then she may raise that request to the Court following service of Defendants. The Court wishes to be clear that it is only denying, without prejudice, Plaintiffs request for a temporary restraining order, to the extent she seeks one, and is not dismissing the Complaint. Signed by Judge Robert J. Colville on 3/21/24. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (cjo) |
