February 14, 2011 Filing 23 Hearing Memo from Initial Case Management Conference Held on 2/11/2011. The initial scheduling conference took place in chambers. Mr. Urban appeared in person. Mr. Packel and Mr. Kobus appeared via telephone. The attorneys entered their appearances. The Court noted that the parties had filed the required Rule 26(f) report and proposed an initial scheduling order, however there was nothing on the docket regarding ADR no mediator had been named, nor a deadline for completion of ADR, nor a proposal for allocation of costs. Mr. Urbin stated that the parties had discussed ADR but there were some issues. Mr. Kobus elaborated that the issues were financial, specifically how the claimed damages were related to the departure of employees, and stated that if there was some early discovery related to these documents/claims then he believed that mediation could take place. The Court expressed its concern that mediation should not be unduly delayed. Mr. Urban stated that the parties had exchanged initial disclosures and calculations, and offered to provide some financial documents on an expedited basis, probably within thirty (30) days, and therefore the parties should be able to complete mediation within ninety (90) days. The Court therefore suggested a mediation deadline for the middle of May, and reminded the parties that they still needed to choose a mediator. The parties agreed to make a filing informing the Court of their choice of mediator by Friday, February 18, 2011. The Court inquired whether or not there were any dates in dispute in the scheduling order. The parties said there was no dispute as to dates. The Court reminded the parties that if any dates needed to be revised, that they would need to file a motion. The conference adjourned. (dlg)
