MEMORANDUM OPINION AND ORDER OF COURT denying 44 Motion for Summary Judgment; granting in part and denying in part 50 Motion for Summary Judgment. Defendants' Motion for Summary Judgment is Granted with respect to the claims arising under t he Housing Act and Fourteenth Amendment and Denied with respect to the claims arising under the FHAA, the Rehabilitation Act and the ADA. The Plaintiff's request for punitive damages is Dismissed. Defendants Cheryl Johns and Linda Walter are D ismissed as parties to this action and the caption is Amended to reflect the fact that only the Altoona Housing Authority remains as a defendant in this case, and as more fully stated in said Memorandum Opinion and Order of Court. MEMORANDUM OPINION AND ORDER OF COURT - this matter coming before the Court on Defendants' Motion to Dismiss Verified Complaint (Doc. No. 4 ), it is hereby ORDERED as follows: Defendants' Motion is GRANTED as to claims under the Americans with Disabilities Act, the Rehabilitation Act, and the Fair Housing Act against Defendants Walter and Johns in their individual capacities only. These claims are dismissed WITH PREJUDICE. Defendants' Motion is DENIED in all other respects, and as more fully stated in said Memorandum Opinion and Order of Court. Signed by Judge Kim R.
