May 11, 2018 Opinion or Order Filing 24 MEMORANDUM OPINION AND ORDER - in consideration of PrimeCare's partial motion to dismiss and motion to strike (ECF No. 15 ), and for the reasons stated in the accompanying memorandum opinion, IT IS HEREBY ORDERED as follows: PrimeCare's pa rtial motion to dismiss is GRANTED in part and DENIED in part as follows: a. The motion to dismiss is DENIED with respect to the corporate negligence claims (Counts VII and VIII), which remain in the case. b. The motion to dismiss is GRANTED with r espect the § 1983 claim against PrimeCare (Count IV) to the extent it asserts a Fourth Amendment claim. The other claims in Count IV remain.
