Filing 4 TEXT ORDER denying #3 Motion for Reconsideration re #2 Order dated November 20, 2018. The Court finds that reconsideration is not warranted as Petitioner does not identify any newly discovered fact or principle of law, nor is there a basis to conclude that the Order was manifestly incorrect. Petitioner is challenging under the Eighth Amendment the denial of replacement or repair of his hearing aides and the replacement of a CPAP mask. As such, these claims should be brought through a civil rights action, as the relief requested is not one which can be granted through a habeas action. Signed by Chief Magistrate Judge Cynthia Reed Eddy on 12/4/2018. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (bsc) |
