ORDER granting #3 Motion for Leave to Proceed in forma pauperis. Plaintiff is directed to file his Complaint no later than May 28, 2026. IT IS HEREBY ORDERED that: 1. No later than May 28, 2026, the inmate officer or other appropriate officer at Plaintiff's place of imprisonment shall submit an initial partial payment of 20% of the greater of: 1) the average monthly deposits to Plaintiff's account for the past 6 months, or 2) the average monthly balance in Plaintiff's prison account for the past 6 months. 2. Plaintiff is warned that he is ultimately responsible for payment of the filing fee if the agency with custody over him lapses in its duty to make payments on his behalf. The Clerk shall provide Plaintiff with a copy of the Authorization Form along with this Order. On or before May 28, 2026, Plaintiff shall (1) submit his completed Authorization Form to this Court and (2) submit a copy of his completed Authorization Form to the Prison Account Office. Copy of this Order is being mailed to the Inmate Account Officer at Plaintiff's place of confinement. Plaintiff must complete and submit Process Receipt and Return forms, Notice and Request for Waiver of Service of Summons, and Waiver of the Service of Summons for each named Defendant. The Clerk shall mail blank copies of these documents to Plaintiff. Plaintiff must provide accurate and identical copies of the Complaint to the Clerk of Court for each named Defendant, and as more fully stated in said Order. Signed by Judge Stephanie L. DEFICIENCY ORDER: The above-captioned matter will not be processed for failure to comply with the Federal Rules of Civil Procedure, statutory requirements and/or our Local Rules and/or practices. The submission of the complaint is deficient in the following respects: Failure to provide a properly completed Consent to Jurisdiction of Magistrate Judge form. A blank Consent to Jurisdiction of Magistrate Judge form will be attached to Plaintiff along with this Order. Failure to pay the required filing fee OR to complete the Court's form motion to proceed in forma pauperis. A blank copy of the Court's form motion to proceed in forma pauperis will be mailed to Plaintiff along with this Order. If Plaintiff intends to move for leave to proceed in forma pauperis, he must also submit the following with his motion: An authorization form authorizing the withdrawal of funds from an inmate account. A certified copy of Plaintiff's trust fund account statement. Service copies of the complaint for each defendant. "Process Receipt and Return" forms for each defendant. A blank form will be mailed to Plaintiff for each defendant. A complete and signed "Notice and Request for Waiver of Service of Summons" form for each defendant. A blank form will be mailed to Plaintiff. A complete and signed "Waiver of Service of Summons" form for each defendant. A blank waiver will be mailed to Plaintiff. Plaintiff must complete the caption and return the form for each known defendant. As a result of the above-outlined filing deficiencies by Plaintiff, IT IS HEREBY ORDERED that the Clerk of Court mark this CASE ADMINISTRATIVELY CLOSED. IT IS FURTHER ORDERED that Plaintiff may reopen this case by satisfying the filing deficiencies as outlined above. Failure to cure the deficiencies by May 8, 2026 will result in the dismissal of the Complaint for failure to prosecute, and as more fully stated in said Deficiency Order. Signed by Judge Stephanie L.
