We DISMISS WITH PREJUDICE the claim against the ADC and Pereira, Lopez, and Caban-Rosado in their offi cial capacities and the claim for lack of a toilet. We also DISMISS WITHOUT PREJUDICE his claims for failure to provide medical care. We ORDER Plaintiff to SHOW CAUSE, on or before July 29, 2009, as to why we should not dismiss without prejudice his other Eighth Amendment claims relating to conditions of confinement for failure to allege physical injury and failure to allege facts relating to the duration of his confinement in substandard conditions.
