Filing 63 OPINION AND ORDER: We GRANT IN PART and DENY IN PART the Defendants' motion for summary judgment. (Docket No. 19 .) We DISMISS Plaintiff's Fourteenth Amendment claims under § 1983, but all of his other claims against the Municipality and Cintron in his official capacity remain. We quash the in personam jurisdiction over Cintron in his individual capacity because he was only served in his official capacity and, because we do not have proper personal jurisdiction over Cintron in his individual capacity, we GRANT his summary judgment motion. (Docket No. 22 .) We also DENY Defendants' motion to strike. (Docket No. 37 .) Signed by Judge Jose A Fuste on 2/17/2012.(mrj) |
