OPINION AND ORDER re 9 Motion to Dismiss. The Court DENIES defendants' motion to dismiss the case on Eleventh Amendment grounds but GRANTS defendants' motion to dismiss the case with prejudice for failure to state a claim. Plaintiffs� 39; federal claims are DISMISSED WITH PREJUDICE and their Commonwealth law claims are DISMISSED WITHOUT PREJUDICE. This case is DISMISSED in its entirety.
