OPINION AND ORDER re 56 MOTION to dismiss for Fraud on the Court as to Angie Mercado-Cordova filed by Walmart Puerto Rico, 64 INFORMATIVE Motion regarding Mercado's Deliberate and Permanent Deletion of Her Facebook Account and Supplementing Request for Dismissal for Fraud on the Court filed by Walmart Puerto Rico. GRANTED IN PART AND DENIED IN PART. Specifically, Walmart's request for dismissal is denied. However, the Court hereby imposes as sanction an adverse i nference regarding the content of Mercado's Facebook page and her deletion of the related account. OPINION AND ORDER re 39 MOTION for Summary Judgment filed by Walmart Puerto Rico. Defendant's motion for summary judgment (ECF No. 39) is hereby GRANTED IN PART AND DENIED IN PART. Specifically, the Court GRANTS Walmart's summary judgment motion regarding Mercado's claim of disability-based, retaliatory hostile work environment under the ADA, and as to Mercado's claim of age discrimination under Puerto Rico's Law 100.
