March 31, 2022 Opinion or Order Filing 132 ORDER denying #120 Motion for Summary Judgment. The existence of genuine issues of material fact precludes judgment in favor of Defendant. Additionally, Plaintiffs' claim of negligence regarding the onboarding of Maximo Solar does not constitute an impermissible amendment of the pleadings. Plaintiffs' Complaint alleges that Defendant was responsible for the manufacture, design, inspection, and installation of the solar panels. If Defendant hired a contractor to perform these tasks, then the allegation of negligence reasonably extends to Defendants supervision of that contractor. See Docket No. 130 at 7-9. Finally, the Court denies Defendant's request as to Maura's liability under Article 1810. While Article 1810 imposes strict liability, Defendant still needs to establish legal cause between the falling object and the harm caused. No argument has been made as to causation. To the contrary, Defendant admits that it is still disputed whether "the accident here in question was really caused by a solar panel that was thrown or fell from Mauras rooftop." Docket No. 120 at 16; see also id. at 18. Moreover, the Court is not inclined to adjudicate a non-party's liability as to a time-barred claim, especially since Defendant could have included Maura as a Third-Party Defendant in its Third-Party Complaint.
