As the defendant points out, the Local Rules do not provide for a party to file another memorandum after a sur-reply is filed and the Court will not abandon that rule. Furthermore, it is well-known that a litigant may not utilize a sur-reply to raise new arguments it could and should have presented in an earlier memorandum. Southwire Co. v. Ramallo Bros. Printing, Inc., 540 F. Supp. 2d 307, 311 n.5 (D.P.R. 2008). As such, the Court will not allow another filing akin to a sur-sur-reply and will certainly not consider issues raised for the first time in a reply brief.
