MINUTE ORDER TO SHOW CAUSE RE: TRANSFER by Judge Stanley Blumenfeld, Jr.: Cross-Claimant filed an ex parte application seeking to serve both Martinez-Davila and Utopia by publication #12 . The Court is not inclined to grant the application for two reasons. First, the Court already found after extensive litigation that there is no personal jurisdiction over Martinez-Davila and Utopia in the Central District of California. Second, Ginzburg is already litigating a similar case against Martinez-Davila and Utopia in the District of Puerto Rico. An assessment of the recently amended complaint in the PR Case (filed August 3, 2021) reveals that the instant case arises from the same or closely related transactions, happenings, or events and calls for determination of the same or substantially related or similar questions of law and fact. Under these circumstances, transfer of this case to the District of Puerto Rico seems appropriate. For these reasons, Ginzburg is ordered to show cause in writing by no later than 8/20/2021 why this case should not be transferred to Puerto Rico. Court Reporter: N/A.
