Pursuant to Plaintiff, United States of America, on behalf of the United States Environmental Protection Agency (EPA), Motion to enter Proposed Consent Decree (Docket No. 5) and the parties, United States of America and To Go Stores, LLC, Proposed Consent Decree (Docket No. 2-1), and the Courts Order approving the same IT IS HEREBY ORDERED, ADJUDGED AND DECREED THAT: 1.All terms and conditions of the Consent Decree are incorporated herein by reference. See Docket No. 2, Exhibit 1. 2.The appearing parties expressly agree that the Judgment will be deemed final and enforceable as of the date it is entered by the Court. 3.The Court shall retain jurisdiction as to the enforcement of the Settlement Agreement. 4.Each party shall bear its own costs and attorneys fees.
