Minute Entry for proceedings held before Judge Raul M. Arias-Marxuach: Initial Scheduling Conference held on 7/22/2022. Present on behalf of the plaintiffs were attorneys Andres Gorbea and Hector Figueroa; on behalf of the defendants were attorneys Pablo Tufino and Fernando Valderrabano. The Court inquired as to when would defendants respond to the Motion for Preliminary Injunction filed by plaintiffs at ECF No. #22 . Defense counsel's statements based on the possible unconstitutionality of the injunctive relief and defendant not being liable for interruption in services were heard. Plaintiff's response in opposition of immunity was heard. By August 10, 2022, plaintiff shall show cause whether case should be not dismissed for lack of subject matter jurisdiction and disclose whether there is any insurance as required by the Mandatory Initial Disclosure regime in Rule 26. By August 24, 2022, defendants shall raise any claim of immunity whether constitutional or under PROMESA. Plaintiff counsel informed that an Amended Complaint will be filed on July 27, 2022.
