ORDER re #1 MOTION to Vacate, Set Aside or Correct Sentence (2255) (Criminal Number 18-770) filed by Alberto Jose Rodriguez-Medina. Petitioner's habeas petition, filed Prose, on August 26, 2022 (ECF No. 1) is nearly a year late, articulates no arguments that he has tolled the prescriptive period, or otherwise makes an attempt to excuse his delay in filing for Section 2255 relief. The criminal Case (Crim. Case No.18-770) record reflects petitioner was sentenced on 8/4/2020. Crim. 18-770 at ECF No. 74. No appeal was undertaken.
