ORDER. A review of the docket in Cr. Case No. 14-166 (FAB) shows that Plaintiff, represented by the FPD in said case, filed several motions requesting a sentence reduction which were denied by the Court. See Cr. Case No. 14-166 (FAB), Docket Nos. 709, 727, 729 and 730. Plaintiff appealed the Order entered against him on November 7, 2023 denying his Supplemental Motion for Nine-Month Sentence Reduction by the Hon. Francisco A. Besosa. (Cr. Case No. 14-166 (FAB), Docket No. 733). Said appeal is pending. The instant case is directly related to the pending appeal in Cr. Case No. 14-166 (FAB) inasmuch as Plaintiff in the instant case is claiming damages for the alleged failure to give him credit towards his sentence. As such, the present case is DISMISSED WITHOUT PREJUDICE sua sponte as premature pending the appeal in Cr. Case No. 14-166 (FAB). See 28 U.S.C. 1915(e)(2). Judgment shall be entered accordingly.
