July 22, 2019 Filing 8 NOTICE of Appearance by William Norman Nettles on behalf of Nutramax Laboratories Veterinary Sciences Inc (Nettles, William)
July 15, 2019 Filing 7 TEXT ORDER: This matter is before the court pursuant to Plaintiff Nutramax Laboratories Inc.'s unopposed Motion for Leave to File under Seal the Complaint and its accompanying Exhibits. (ECF No. #1 .) Nutramax asserts that the Complaint and Exhibits should be sealed because they contain three confidential business agreements between Nutramax and [Defendant] Candioli. (ECF No. #1 at 1.) In order to seal a document, the court must: "(1) give the public adequate notice that the sealing of documents may be ordered, (2) provide interested parties an opportunity to object to the request before the court ma[kes] its decision, (3) state its reasons on the record, supported by specific findings, and (4) state its reasons for rejecting alternatives to disclosure." Rushford v. New Yorker Magazine Inc., 846 F.2d 249, 25354 (4th Cir. 1988). Upon review, the court observes that Nutramax's Motion to Seal was filed timely on June 26, 2019, through the court's CM/ECF system and has satisfied the requirement of public notice. See LOCAL CIV. RULE 5.03 (D.S.C.) ("The clerk of the court shall provide public notice of the motion to seal in the manner directed by the court. Absent direction to the contrary, this may be accomplished by docketing the motion in a manner that discloses its nature as a motion to seal."). The court further observes that Nutramax's motion to seal provided the public with adequate time to object to the Motion. The court also recognizes that in order to facilitate the resolution of disputes, the court generally tries to maintain the confidentiality of sensitive information exchanged in the litigation, like the business agreements attached in the complaint. Rushford, 846 F.2d at 253. Under these circumstances, the court has considered less extreme alternatives to sealing Nutramax's Complaint and Exhibits and determined that such alternatives would have a negative impact on the parties' efficiency to litigate this matter. Lastly, the court observes that Plaintiff's Motion is unopposed. As a result of the foregoing, the court GRANTS Nutramax's Motion for Leave to File under Seal its Complaint and accompanying Exhibits (ECF No. #1 ). Signed by Honorable J Michelle Childs on 7/15/2019. (mbro, )
