June 2, 2023 Filing 13 DOCKET TEXT ORDER denied without prejudice #11 Plaintiff's Motion to Amend/Correct Complaint. Pursuant to Fed. R. Civ. P. 15(a)(1)(A), a party may amend his pleading once as a matter of course within twenty-one days after service of the Complaint. However, Plaintiff's proposed amended complaint must be complete in itself. Plaintiff is reminded that an amended complaint replaces the original complaint. See Young v. City of Mount Ranier, 238 F.3d 567, 572 (4th Cir. 2001) ("As a general rule, an amended pleading ordinarily supersedes the original and renders it of no legal effect.") (citation and internal quotation marks omitted); see also 6 Charles Alan Wright et al., Federal Practice and Procedure 1476 (3d ed. 2017) ("A pleading that has been amended under Rule 15(a) supersedes the pleading it modifies and remains in effect throughout the action unless it subsequently is modified. Once an amended pleading is interposed, the original pleading no longer performs any function in the case..."). Any amended complaint filed by Plaintiff is also subject to further initial review by the court pursuant to 28 U.S.C. 1915A. This motion is denied without prejudice for Plaintiff to refile a proper amended complaint on or before June 16, 2023, if he so elects. Entered at the direction of Magistrate Judge Paige J. Gossett on 6/2/2023. (kkus, )
