OPINION AND ORDER concurring with the 57 Report and Recommendation and granting in part Defendants' 51 Motion for Summary Judgment as to Plaintiff's §1983 claims against the individual Defendants. It is fu rther ordered the Defendants' 51 motion for summary judgment is denied without prejudice in part to allow Plaintiff to purse his remaining causes of action in state court. Accordingly, state law claims against SCDC are remanded to the Court of Common Pleas for Dorchester County, South Carolina. Signed by Honorable Margaret B. Seymour on 7/19/2019.
